One of the most important protections in Medigap law is the guaranteed issue right, a set of specific circumstances where a Medigap insurer must sell you a plan without reviewing your health history, without charging extra for pre-existing conditions, and without imposing waiting periods. Outside these protected windows, Medigap insurers in most states can medically underwrite applicants and decline coverage to those with health conditions. Knowing every situation that triggers a guaranteed issue right is essential for protecting your access to Medigap coverage regardless of what happens to your health.

Bryce's Take

The trial right in the first year of Medicare Advantage is the most important guaranteed issue protection most people do not know they have. If you enrolled in Advantage at 65 and it is not working, the network is wrong, the prior auth is frustrating, you miss your old doctors, you have one shot at switching back to Medigap without underwriting. That window is 12 months. After that, it gets significantly harder.

The foundational window: Medigap open enrollment

The most important and widely available guaranteed issue period is the six-month Medigap Open Enrollment Period that begins the month you are both age 65 or older and enrolled in Medicare Part B. During these six months, any Medigap insurer licensed in your state must sell you any Medigap plan they offer without medical underwriting. After this window closes, underwriting applies in most states and insurers can decline you. This is the reason choosing a Medigap plan at initial Medicare eligibility is so important: once open enrollment ends, access to Medigap without health conditions is no longer guaranteed in most states.

Your Medicare Advantage trial right

If you enroll in a Medicare Advantage plan for the first time at age 65 and within the first 12 months decide you want Original Medicare plus Medigap instead, you have a one-time guaranteed issue right to purchase Medigap without underwriting. This right lasts until you have been in the Advantage plan for 12 months. The trial right can only be used once; if you return to an Advantage plan and later want Medigap again, the trial right does not apply a second time.

Losing other coverage through no fault of your own

Several situations trigger guaranteed issue rights when you lose coverage involuntarily. If your Medicare Advantage plan leaves the Medicare program or stops serving your area, you have a guaranteed issue right to enroll in Medigap. If your employer-sponsored health coverage ends (including retiree coverage), you have a guaranteed issue right for a period following that loss. If a Medicare SELECT plan, a Medigap plan that uses networks, closes and you were enrolled in it, you have a right to enroll in a comparable Medigap plan.

Moving out of a Medicare Advantage service area

If you permanently move out of your Medicare Advantage plan's service area, you gain a guaranteed issue right to enroll in a Medigap plan in your new location. This applies whether you are moving across the county or across the country. The right must be exercised within the applicable window from the date of your move or plan coverage end.

These windows close quickly and missing them has real consequences. I can tell you exactly whether your situation qualifies and how to use the right before the window expires.

Plan insolvency or fraud

If your Medicare Advantage plan or Medicare SELECT plan becomes insolvent (goes bankrupt) or is found to have committed fraud or misrepresentation in its marketing or enrollment, you gain a guaranteed issue right to enroll in Medigap. This is a consumer protection designed to ensure that beneficiaries harmed by plan failures can still access supplemental coverage.

State-level additional protections

Several states provide broader guaranteed issue rights than federal law requires. Connecticut, Massachusetts, Maine, and New York require Medigap insurers to sell to any Medicare-eligible applicant regardless of health status, year-round. Washington state has a birthday rule allowing beneficiaries to switch Medigap plans annually around their birthday without underwriting. Missouri and Oregon have similar birthday rules. California has a birthday rule that allows switching to the same or lesser plan. Florida has a special annual enrollment window. These state protections significantly expand access to Medigap for residents who live in these states.

What guaranteed issue means in practice

When you have a guaranteed issue right, the insurer must: accept your application without reviewing your health history, offer you the plan at the standard rate for your age and location without a surcharge, cover your condition immediately without a waiting period. The guaranteed issue right does not fix the price of the plan, you still pay standard market rates. But it removes the underwriting barrier that blocks many people with health conditions from accessing Medigap outside the initial open enrollment period.

Frequently asked questions

How long do guaranteed issue rights windows last?
Most guaranteed issue windows are 63 days from the triggering event, for example, 63 days from the date your Advantage plan leaves your area. The Medigap Open Enrollment Period is 6 months from when you turn 65 and enroll in Part B. Specific window lengths vary by the type of guaranteed issue right.
Does a guaranteed issue right let me choose any Medigap plan?
In most guaranteed issue situations, you can choose from Plans A, B, C, F, K, or L (depending on which are sold in your state and your Medicare eligibility date). Some rights are limited to specific plan letters. The trial right, for example, typically allows access to any plan available in your state from any insurer.
If I am in a state with year-round guaranteed issue, can I switch plans anytime?
In states like New York, Connecticut, Maine, and Massachusetts with continuous open enrollment, you can apply for any Medigap plan at any time without underwriting. However, switching while already enrolled in a Medigap plan from a different insurer may involve a brief gap in coverage, and you should confirm effective dates before dropping existing coverage.
Does a guaranteed issue right mean I pay the same rate as a healthy person?
Yes. Guaranteed issue rights prohibit health-based pricing. You pay the standard market rate for your age, sex, and location that would apply to any applicant. Some states also limit age-based rating, further standardizing premiums.
